Can you add another attorney to a Lasting Power of Attorney?

This week’s short blog focuses on a commonly asked question; can you add an attorney to an existing Lasting Power of Attorney? I’ll answer the question and include why it’s important to know this when making your Lasting Power of Attorney.

When a Lasting Power of Attorney has been drafted and signed it must be sent to the Office of the Public Guardian for registration. Once registered it cannot be amended, this means you cannot add an attorney at a later date.

 

To add a new attorney

The only way you can add a new attorney is to end or revoke the LPA and register a new one.

Why does this matter?

Making a Lasting Power of Attorney involves both time and cost, it’s not something that you have to re-do in the future. It is a valuable legal document and setting it up correctly first time is important because, by the time it is needed, it may be too late to begin the process again.
